Terms and conditions of sale
These terms govern your purchase from PC Mega Mart Pty Ltd (ABN 54 676 397 032), trading as PC Mega Mart. By placing an order you accept them.
Nothing in these terms excludes, restricts or modifies any right you have under the Competition and Consumer Act 2010 (Cth), including the consumer guarantees in the Australian Consumer Law. Where a term conflicts with that Act, the Act wins and the term does not apply.
1. Prices
All prices on our Australian store are in Australian dollars and include GST.
Our prices track live distributor cost and change frequently, sometimes several times a day. The price that applies to your order is the price displayed at the moment you complete checkout. We will honour that price even if our cost rises afterwards.
Where we show a saving, it is measured against the manufacturer's recommended retail price as supplied in the vendor's own data feed. RRP is a manufacturer's recommendation and not necessarily a price the product has been sold at in the market.
2. Payment and card surcharge
We accept the payment methods shown at checkout. Payment is taken in full at the time of order.
A card surcharge may apply. Where it does, it recovers the cost our payment provider charges us for that payment method and no more, as the Reserve Bank of Australia's surcharging standard requires. The exact amount is itemised at checkout before you pay and appears as a separate line on your tax invoice. If you would rather not pay it, choose a payment method that does not attract one.
Card details are handled by our payment provider and are never stored on our systems.
3. Order acceptance
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation for the goods in question — not when you receive the order confirmation email, and not when your payment is authorised.
We may decline or cancel an order, refunding you in full, where:
- The product is out of stock or has been discontinued by the manufacturer
- The price or a product description was obviously wrong — a pricing error a reasonable person would recognise as a mistake rather than a bargain
- We cannot verify your identity or payment, or we reasonably suspect fraud
- Delivery to your address is not something our carriers can do
Where we cancel, we refund the full amount to your original payment method, including any surcharge.
4. Stock and backorders
Stock figures come from our distributors and are refreshed through the day. They are accurate when the page loads but are not a reservation: stock can sell between your order and the warehouse picking it.
If an item you ordered is unavailable we will contact you with an expected date. You may wait for it, substitute it, or cancel that item for a full refund. We will not substitute a different product without your agreement.
5. Delivery
Delivery terms, costs and timeframes are on our Shipping page and form part of these terms. Delivery estimates are carrier estimates, not guarantees.
Risk in the goods passes to you on delivery. Title passes when we have received payment in full.
6. Returns, warranty and consumer guarantees
Your rights on faulty goods, and our 30-day change-of-mind policy, are set out on our Warranty and returns page, which forms part of these terms.
7. Product information
Product descriptions, specifications and images are supplied by manufacturers and distributors. We reproduce them in good faith but do not author them. Manufacturers change specifications without notice, and images are often representative rather than exact — accessories or configurations shown are not included unless the description says so.
If a product's actual specification differs from what our page said at the time you bought it, that is a discrepancy we will fix: contact us and we will refund or replace.
8. Business customers
Where you buy wholly or predominantly for business use and the goods are not of a kind ordinarily acquired for personal, domestic or household use, the consumer guarantees may not apply. In that case our liability for a defective product is limited, at our option, to replacing the goods, repairing them, or paying the cost of doing either.
Nothing in this clause limits liability that cannot be limited at law, including liability for death or personal injury caused by our negligence, or for fraud.
9. Liability
To the extent the law allows, we are not liable for indirect or consequential loss — including loss of profits, loss of data, loss of business opportunity, or the cost of substitute goods — arising from your purchase.
Our total liability for any claim is limited to the amount you paid for the goods that gave rise to it.
Back up your data before sending any device for repair or return. We are not liable for data lost during repair, and repairs may erase storage entirely.
10. Accounts
You are responsible for keeping your account password confidential and for orders placed through your account. Tell us immediately if you believe your account has been accessed by someone else.
We may suspend or close an account used for fraud, abuse of our staff, or systematic resale in breach of a manufacturer's distribution terms.
11. Intellectual property
The site's design, code, layout and original text are ours. Product images, manufacturer descriptions and brand marks belong to their owners and are used under our distribution arrangements. You may not scrape, copy or republish the catalogue.
12. Governing law
These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
13. Changes
We may change these terms. The version that applies to your order is the version published when you placed it.
